Western Maine Limousine
Terms and Conditions
Of Service

Western Maine Limousine agrees to provide a limousine and chauffeur at the time, date and location specified on contract. As with all contracts, the rental contract between the mentioned person as Contractual Party and Western Maine Limousine is made with the information and the terms given to us. All of the given information from the Contractual Party is binding and cannot be changed without Western Maine Limousine acceptance.

PAYMENTS AND DEPOSITS:
A valid credit card is required for all services. Contracted price is set for contracted pickups, addresses, time and number of passengers. Western Maine Limousine rates are billed, including, applicable fees / taxes and a 20% Chauffeur service charge. If you feel that you would like to provide an additional service charge it is at your sole discretion. If you choose to provide an additional cash service charge; it is at your sole discretion, and is only in addition to the 20% you have already paid for. You will not receive a full or partial refund for the 20% Service charge by providing a cash tip to the Chauffeur. We will reserve the said date upon the approval of the Contractual Party’s credit card. It is agreed that it is not necessary to obtain a signed credit card slip, if the reservation is made over the phone or internet. Proof of identity of the Contractual Party using said credit card must be supported by the signed contract / credit card authorization via email or in person. At time of pickup we need the credit card, state identification of the Contractual Party that authorizes the transaction for the signed contract. If the Contractual Party cannot provide all of the above items at the time of pickup, Western Maine Limousine will not start the job, as we have no proof of the legal possession of the credit card. Therefore the risk of not getting paid will give us the right to cancel. The Contractual Party is still fully responsible to pay the total amount as he failed to provide the above requirements. No reservation will be valid until the Customer Agreement is signed and returned to Western Maine Limousine via mail, or email prior to the date of service. There will be no exceptions made with this policy. The Contractual Party assumes full financial responsibilities for all payments and additional fees due in full at the conclusion of the service. The Contractual Party authorizes changes to credit card, with/without imprint. The credit card holder gives authorization to use the credit card information over the phone or internet in combination with a signed contract. The Contractual Party authorizes the immediate withdrawal of the $100 deposit fee & the final payment plus 20% gratuity upon completion of service. The Contractual Party, states that she/he is the authorized The Contractual Party for this rental contract, the authorized cardholder for the given credit card, and is solely responsible and liable for payment of the total amount quoted and any addition fees or charges assessed within this contract. Deposits are charged on the credit card you provide with this contract and are non-refundable for any reason. If the contract is cancelled or accepted after it is signed, Western Maine Limousine is still authorized to collect the remaining balance in full, if the car was not re-rented again on the cancelled date for the same or higher amount.
WAIT TIME: On all the transfers Western Maine Limousine provides up to a 15 minute grace period at pick-up; before wait time charges apply at the hourly rate of the vehicle + 20% service charge billed in one hour increments.
ADDITIONAL CHARGES: When, at the request of the Contractual Party, any change in Itinerary or other element of services is made such as an increase in miles or hours to that specified in the Contract, an additional charge shall be made. The Contractual Party will also be responsible for payment of all tolls, highway fees, and parking fees and other similar out-of-pocket expenses incurred in connection with the Contracted Services. Western Maine Limousine will generally attempt to include the full amount of any additional charges that may reasonably be expected to be incurred and incorporate such amounts into the Service Contract; provided, however, that the failure to list any such fees or expenses shall not affect the Chartering Party’s sole responsibility there for.
DELAY OF SERVICE: In the event there is a delay in travel caused by an Act of God, severe weather and/or road conditions and/or unforeseen traffic resulting in any of the contracted vehicles arriving late at the first pick-up address, Western Maine Limousine will modify the drop-off time to account for the amount of time caused by the delay. You agree that this action will be made adequate compensation for the delay and there will be no further liability incurred by Western Maine Limousine. Western Maine Limousine will make every effort to arrive on time even in the above situations. We will use our best efforts to notify the customer of these conditions and resulting delays or changes.
CANCELLATION: The Contractual Party must notify Western Maine Limousine of Cancellation via mail or email. There is no cancellation fee if the cancellation is made at least thirty (30) days prior to the Date of Service. If service is cancelled within 14 days of Date of Service a 50% cancellation fee will apply. Cancellations made within 7 days of Date of Service will be subject to a 100% cancellation fee, with no exception. Please note…that a change in date of service is considered a cancellation, unless Western Maine Limousine is notified within the 30 day time period and can accommodate the date and hours of service. Deposits are non-refundable. Western Maine Limousine reserves the right to cancel your limousine service due to inclement weather such as, but not limited to, slippery road conditions, or in the event snow, sleet or freezing rain. This is to ensure the safety of all parties concerned. In the event of a cancellation by Western Maine Limousine due to inclement weather, we will try to accommodate your service on the next available date. In the event that we cannot accommodate your date due to other reservations and obligations, we will issue a full refund for services including your initial deposit. Unsafe road conditions due to excess snow or ice, but not limited to, may require us to return your party to the designated drop off earlier than time specified in the service agreement. We will not jeopardize the safety of our drivers, clients or vehicles in unsafe road conditions or any other hazardous situation. If under these circumstances a service is not rendered for the full contracted time, Western Maine Limousine will reimburse the Contractual Party for the time difference
NO SHOW: If customer fails to show at designated pick up location the full amount of contracted time will be charged. On all reservations you will be considered a no- show at 45 minutes past your scheduled pick-up time; if you have not met your Chauffeur or contacted us by phone, you will be charged in full for the reservation. To avoid being charged as a no-show, contact Western Maine Limousine or the driver by phone. Communication MUST be by phone not via email or answering service as we may not have access to those services at the point of pickup. It is of particular importance that the Contractual Party makes allowances for anticipated delays and adheres to the agreed time schedule.
MECHANICAL BREAKDOWN: Western Maine Limousine cannot be held liable in the event of mechanical breakdown and will only be held responsible for reimbursement of lost hours of service. Western Maine Limousine agrees to send the requested vehicle as offered in the contract. We have the right to switch the vehicles in case of emergency breakdown or if vehicles were in accidents. As stated, this will only happen in emergencies. No additional charges will occur on customer side. If switching occurs in the same category, it will not affect the contract and / or payment of contract. Customer’s therefore accepts that replacement limousine may be substituted if contracted limousine becomes unavailable for any reason.
BAGGAGE AND PERSONAL PROPERTY TRANSPORTED: Western Maine Limousine does not assume any responsibility whatsoever for the handling or maintenance of any baggage, parcels or other personal property. Baggage and all other personal property will be handled only at passengers’ own risk. Passengers’ baggage shall be transported subject to the available accommodations provided by interior and/or exterior racks.
DAMAGES: The Contractual Party is responsible for guests and assumes full responsibility for any damages to vehicle caused by Contractual Party or guest whether by accident, neglect, or intent. The Limousine shall be inspected upon conclusion of the engagement, by Western Maine Limousine, if any new damage is found in the Limousine it will be the responsibility of Contractual Party. Contractual Party shall be charged for all repairs and any unusual cleaning that was caused by members of his/ her party being transported. Contractual Party agrees to allow these charges to be automatically deducted from the credit card on file.

The Contractual Party agrees to be fully responsible for damages and additional charges as listed below:

$25.00 Minimum per broken glassware.
$ 700.00 Minimum per damaged seat
$ 500.00 Minimum per damaged carpet
$ 750.00 Minimum per damaged mirror
$ 150.00 Minimum for extensive cleanup (spills, etc.)
$ 100 Minimum for a gum in the carpet clean up
$ 50.00 minimum shampoo and disinfecting (due to sickness interior)
$ 50.00 minimum detailing and wax (due to sickness-exterior)
$ 500.00 minimum for each burn hole, rip or tear to upholstery
$ 500.00 minimum for each act of vandalism
$ 2000.00 minimum for opening a car door into another Vehicle or Stationary Object
$100 minimum for cleaning and deodorizing due to smoking in vehicle
Triple charge of above listed amounts for all removed / stolen items from vehicle
Extreme damage will be estimated by a professional

EQUIPMENT: Specified Equipment type, size and age is not guaranteed and is only an estimate based on information at time of booking. The Service Provider reserves the right to substitute other Equipment sufficient to accommodate the number of passengers specified in the Service Contract and no refunds shall be given as a result of substitute Equipment. Since Western Maine Limousine offers high-tech-equipped vehicles, sometimes heat, AC and other powered equipment may be subject to temporary failure due to excessive use of all power-operated equipment. This will of course not interfere with the safety of the vehicle itself and therefore will have no effect on continuing or paying of the contracted trip. Western Maine Limousine guarantees, that all our vehicles are constantly checked to keep the highest possible standards and eliminate such failures as much as possible.
HOLIDAYS: Service provided during the following holidays will be assessed an additional $100.00 charge. Christmas Eve, Christmas Day, New Year’s Eve, New Year’s Day, Easter, Thanksgiving Day and July 4th.
PROHIBITED ITEMS: Weapons of any type, including firearms, are strictly forbidden on any Equipment (whether in baggage or on the person) at any time. Transportation of explosives, fireworks and other flammable, Combustible, toxic or otherwise dangerous materials or items or pets or livestock of any kind are also strictly forbidden, even if intended to be Transported in the baggage compartment of the Equipment.
OVERTIME: Western Maine Limousine cannot guarantee the availability of overtime. It is of particular importance that the Contractual Party makes allowances for anticipated delays and adheres to the agreed time schedule. In the event that the Contractual Party wants to change the time of the itinerary, they may do so, only if WESTERN MAINE LIMOUSINE can accommodate other clients that may have booked with WESTERN MAINE LIMOUSINE prior to, or after, the said time. Overtime is charged in 1 hour increments and must be paid before the overtime begins.
CONFIDENTIALITY: Western Maine Limousine, and its employees, agents, or representatives will not at any time or in any manner, either directly or indirectly, use for the personal benefit of Western Maine Limousine, or divulge, disclose, or communicate in any manner, any information that is proprietary, personal or compromising to Contractual Party. Western Maine Limousine and its employees, agents, and representatives will protect such information and treat it as strictly confidential. This provision will continue to be effective after the termination of this Contract.
CLIENT/ PARTY SAFETY: Western Maine Limousine will not be responsible for injuries that may occur due to horse playing while the vehicle is in motion, at a standstill or entering and exiting vehicle. The Contractual Party is responsible for his or her guests. Contractual Party or any one traveling in the Limousine under this Contract shall remain inside of the passenger cabin at all times while the vehicle is in motion and shall not stand or hang out of the sunroof or windows.
OBJECTIONABLE PERSONS: Western Maine Limousine reserves the right to refuse to transport persons under the influence of Intoxicating liquor or drugs, or who are, or are likely to become, objectionable to other persons or if the driver feels threatened in any way.
TERMINATION OF SERVICES: WESTERN MAINE LIMOUSINE reserves the right to terminate any reservation without refund, if the operator or the Dispatcher on duty feels that the Contractual Party and /or Party of the Contractual Party is putting the operator or the mode of transportation or the Contractual Party/and/or Party of the Contractual Party in danger of injury. Western Maine Limousine will strictly enforce State and Federal Laws and will maintain a zero tolerance compliance policy that no alcoholic beverages can be consumed or used by any person not of legal drinking age. All U.S. law enforcement agencies have absolute power to stop any motor vehicle for administrative searches. If contraband is aboard, even in negligible quantities without the chauffeur’s knowledge, they can seize and forfeit this vehicle to a local government agency. All law enforcement agencies are aggressively enforcing this policy. Therefore no person will bring contraband aboard vehicles that are owned or operated by Western Maine Limousine.

The following are strictly prohibited and any violation thereof is subject to termination of our service:

Driver may terminate charter at any time without refund if the driver deems the party unruly or endangering the safe operation of the vehicle.
Zero Tolerance: It is illegal to consume alcohol under the age of 21. Possession or consuming any type of illegal drug is prohibited
Possession of weapons or firearms
Acts of aggression or verbal threatening towards any passenger or driver of contracted vehicle
Hanging any portion of body out the windows is prohibited
Vandalizing, damaging, staining, breaking any part of the vehicle, including the interior, exterior as well as glasses and other items in or on the vehicle are prohibited and subject to additional charges
Any act deemed hazardous to the safety of all concerned
Passengers shall not interfere with the Operator in the discharge of his/her duty or tamper with any apparatus or Appliance on the bus
Note: In the event of any violations of the above regulations, our chauffeur will immediately terminate his service and all passengers will be dropped off at the initial pickup point. The total contract price will be charged. No refunds are given and all deposits are non-refundable.

ADDITIONAL TERMS AND CONDITIONS:
We assume no responsibility for articles left in vehicles.
Driver is not responsible for illegal acts during rental.
If the limousine rental is for a minor under the age of (18) eighteen this agreement must be signed by either a parent or legal guardian over the age of (18).
The driver may inspect all bags for youth transports and require storage in the rear compartment.
The driver reserves the right to open the partition to assess the safety of his passengers
Partition will not be closed during the prom season
No Styrofoam coolers or coolers with a drain plug are allowed inside the vehicle, coolers with solid bottom permitted.
No outside food allowed without prior permission. Light snacks such as chips or pretzels are permitted.
Do not stand or dance on the seats. Please keep feet on the floor at all times.
We strongly suggest the use of car seat/ booster seat for children that require one
You may bring CDs, DVDs, or iPod for entertainment; however, homemade or burned CDs do not always play. Please bring your own USB port and/or auxiliary style iPod cord
Ice is normally provided for all limousine services except for shuttling & airport transports.
No smoking is allowed in our vehicles and is subject to a minimum $200 charge for cleaning/ deodorizing
Western Maine Limousine is not responsible for items that are left in the vehicle, lost or damaged. Western Maine Limousine reserves the right to charge a delivery fee for returning lost items if found. Additional charges may apply to delayed flights. The client is responsible to notify us of all airline changes, delays, cancellations & missed flights.
Western Maine Limousine Chauffeur's will assist with luggage at a client's request, but assume no liability for doing so
